ICFFMAJ(ムミア・アブ・ジャマールを気遣う世界の家族と友人たち)は、ダニエル・フォークナー殺害事件に関して州が発表してきたことの正当性を根本的に覆す証拠がジャマール裁判の記録から引き出されたので、報告したいと思います。
州側の最重要証人とされているシンシア・ホワイトさんに対してジョセフ・マッギル地区検事長が法廷で行った尋問の記録を、私たちが 検討したところ、1981年12月9日の問題の事件が起こったとき、ビリー・クック(ムミアの弟ウィリアム・クック)のフォルクスワーゲンには、彼以外に乗っていた人物がいたことが判明したのです。

州は、繰り返し、事件当夜ローカスト通りにいた人間は3人だけだと言ってきました。この重要証人と検事とのやりとりは、確実に、そうではなかったことを示しています。クック裁判でシンシア・ホワイトから引き出された証言は、ジャマール裁判での証言とは、著しく異なっています。右と左の区別も、背の高い人と低い人の区別もつかず、闇と光も、アフロヘアとドレッドロックも区別できない、州の最重要証人が、明確に、また異論も受けずに、車のなかに乗客がいたと述べているのです。州は、彼女を信じさせようとしているのですが、この事実はゴミのように無視したのでした。
この記録が明らかにしているのは、職業上の理由から州の操作を受けやすい弱味のある証人を、州がいかにやすやすと、自分たちの目的のために利用するかということです。州は、その権力を利用して、彼女に見聞きしたと言わせたいことを見聞きしたと言わせましたが、彼女が、もう一人の人を見たという他の証人たちの証言を裏づける言葉を口にしているところでは、それを無視したのです。
ICFFMAJは、この報告が、ねじ曲げられた正義の天秤に、ムミア・アブ・ジャマール裁判の露骨な不公正さを証明するおもりをもうひとつ付け加えるものだと信じます。

ICFFMAJ wants to report the existence of facts drawn from the record in the Jamal case that seriously undercut the state's portrayal of events:
In our review of the transcript we have found from the mouth of the state's so-called star witness, Cynthia White, and District Attorney Joseph McGill, evidence that there was a passenger in Billy Cook's Volkswagen on Dec. 9, 1981 at the time of the incident in question.
Read the following account taken verbatim from the pages from Commonwealth v. William Cook March 29, 1982 during a bench trial in municipal court in Philadelphia.
[McGill] Q. When the officer went up to the car, which side of the car did the officer go up to?
[Cynthia White] A. The driver side.
[McGill] Q. The driver side?
[Cynthia White] A. Yes.
[McGill] Q. What did the passenger do?
[Cynthia White] A. He had got out.
[McGill] Q. What did the driver do?
[Cynthia White] A. He got out of the car.
[McGill] Q. He got out of the car?
[Cynthia White] A. Yes.
The state has claimed repeatedly that there were only three people on Locust Street that night. The words of their star witness and the prosecution certainly suggest otherwise. The testimony elicited from Cynthia White in the Cook case differed markedly from her testimony in Jamal's case.Their star witness who did not know left from right, short from tall, dark from light, or an afro from dreadlocks clearly and without objection stated there was a passenger in the car. The state, that would have you believe her, disregarded that fact like garbage.
What this record reveals is how easily the state can use a vulnerable witness who is by her profession open to state manipulation for their purpose. They used their power to compel her to say and see what they wanted her to say and see, but ignored her where she spoke words that supported other witnesses' reports that they saw another person.
International Concerned Family and Friends of Mumia Abu-Jamal believes that this account is another added weight on the twisted scales of justice that demonstrates the patent unfairness of the trial of Mumia Abu-Jamal.
