EUが提案した子どもの性的虐待をオンラインで闘うための規制の危険性に関する共同声明

欧州委員会が2022年5月11日に提案した「子どもの性的虐待に関する規制（CSA）」に対し、以下に署名した団体、企業、サイバーセキュリティ専門家は以下の声明を発表した：

子どもの性的虐待は深刻な犯罪であり、加盟国はもちろん、世界中の国々で取り組まなければならない。しかし、私たちは、欧州委員会がこの規則案でとったアプローチが、通信の安全やユーザーのプライバシーに壊滅的な影響を与えることを懸念している。

欧州委員会の法案は、加盟国が、エンドツーエンド暗号化メッセージを提供するものも含め、オンラインプラットフォームに対し、ユーザーのコンテンツやメタデータをスキャンしてCSA画像や「グルーミング」会話・行動を調べ、必要に応じて、公的機関に報告し、プラットフォームから削除することを強制することを可能にする。このような要件は、エンドツーエンド暗号化メッセージングと根本的に相容れない。なぜなら、このようなサービスを提供するプラットフォームは、通信コンテンツにアクセスできないからである。このことは、世界中の専門家によって確認されており、特にクライアントサイドスキャンが「失敗し、回避され、悪用される可能性がある」複数の方法に関する詳細なレポートに加え、あらゆる形態のスキャンがエンドツーエンドの暗号化システムをどのように壊すかについての分析が行われている。

エンドツーエンド暗号化と整合せず、全員のセキュリティを低下させるような対策を義務付けるのではなく、規制当局はCSAに対処し、通信セキュリティを保護する対策を奨励すべきである。これらの対策の中には、CSA素材のユーザーレポートを容易にするものがある。
