Special Residence Permission
Ms. T Granted Second Temporary Release for Trial
Ms. T, of Korean citizenship, came to Japan to find work in November of 1989
and, due to circumstances, overstayed her visa. However, as her life here settled
down, she sent for her 6-year-old daughter to join her and the two formed a
close, comfortable household.
In October, 1999, Ms. T applied with the Tokyo Immigration Bureau in order
to gain Special Residence Permission(explained below). Her determination was
strengthened by the Movement for Special Permission that began On September
first of the same year. However, in June of this year, the Minister of Justice
passed a decision rejecting her request. Up until now, nearly all families applying
for Special Residence had a child in middle school or older, and this seemed
to be a factor in the Ministry's considerations. However, Ms. T was turned down
even though her daughter was a freshman (first year) in high school. Therefore,
though the reasons for the ruling are not clear, we can only think its because
they make up a single-parent/mother household or because the daughter is attending
a Korean school and is able to speak her mother's native language. After the
ruling, Ms. T was granted a one-month temporary release from detention in order
to prepare for her and her daughter's journey back to Korea. However, neither
of the two believe that it is possible for them to indefinitely stay in Korea.
Rooted in their strong desire to stay in Japan, Ms. T came to consult with Mr.
Tanaka, APFS's lawyer for Special Permission.
On July 20th, Ms. T's term of release was coming to an end, so APFS, along
with Mr. Tanaka, went to the Immigration Bureau to request an extension. In
response, the case examiner explained that since the last release was granted
so that Ms. T could prepare to leave the country, if, this time, there was no
real evidence of her intent to leave they could not grant an extention. We insisted
that her release was necessary because we were preparing a case to have her
expulsion(rejection of residence permission) overturned(reversed) and were planning
to submit our request for re-examination of her case on that day. The case examiner
refused the extension saying she must have a plane ticket to Korea as evidence.
Since we had no other choice, we bought two plane tickets leaving Japan for
August 19. It took a whole day of negotiations, but in the end, we recieved
an extension for Ms. T's release, thus avoiding the danger that she enter detainment.
Then, August 19th came. Generally, as a policy, the Immigration Department
does not allow renewals for releases granted. However, we began talking with
them at ten in the morning, and, because her case was being reviewed with the
possibilty of being overturned, they unexpectedly agreed that she should be
given a new realease. This meant that they could not RENEW her previous release,
but if she reapplied, they would grant her a NEW release. Since we expected
that she would be sent to detainment, we did not come prepared with a person
to be responsible for her release. However, since it was an emergency, Mr. Tanaka
signed his name and guaranteed her release. The case examiner we met with said
there were a few cases where persons were granted new stay of releases such
as Ms. T's. However, in the cases we've seen at APFS for persons preparing for
a re-trial, Immigration never granted release unless they very specifically
showed they would return to their native country.
In Ms. T's case, the fact that Immigration accepted our case even though we
were arguing an earlier ruling, asking for a re-trial, and did not show she
was preparing to leave Japan, is extremely unusual. From here on, when persons
are not granted special residence, we can now seek temporary release based on
our wish to cooperate with the state(Immigration) when we have decided to reopen
a case in court. Now, all we have to do is use all our energy to get the Ministry
of Justice to overturn the previous ruling.
The Ruling for the ( ) Household from the Third Group of Applicants for Special
Residence has not been Released
Among all participating members of the First, Second, and Third Groups for Special
Permission, only one case, that of the ( ) Father-Daughter Household of Chinese
Citizenship, has not been ruled on. As of March of this year, all other cases
had received their final responses, making it inexcusable that this decision
take so long. In JUne, at our demonstration before the Ministry of Justice,
we also brought this up. We cannot tolerate what appears to be bullying by the
state. We will continue to work hard to ensure that Mr. ( ) and his daughter
get special residence permission.
Tさん母子に訴訟を理由として再度の仮放免認められる
韓国籍のTさんは、1989年11月に就労を目的として来日、事情があり超過滞在となってしまったが、生活も安定してきたため当時６歳になる長女を韓国から呼び寄せて母子で暮らすようになった。Tさんは日本に強固な生活基盤を形成していった。
Tさん母子は在留特別許可(以下、在特)を求めて1999年10月、東京入国管理局に出頭。同年９月１日開始の在留特別許可一斉行動に勇気づけられての決意である。だが本年６月、法務大臣による在特不許可の裁決が出された。これまでの在特一斉行動では、中学生以上の子どもをもつ家族には皆在特が認められており、Tさんの長女もすでに高等部の１年生になっていたにもかかわらずである。母子家庭であること、長女が民族学校に通学し母国語を習得していることなどがその理由として考えられるが、裁決の理由は明らかにされないため不明だ。Tさん母子に出国準備ということで１ヶ月間の仮放免が認められた。だが帰国しても祖国で暮らしていくことは不可能ということで、Tさんたちに帰国の意思はなかった。TさんはAPFSの在特弁護団の田中裕之弁護士に相談した。
７月20日、仮放免の期日が到来。APFSも田中弁護士に協力すべく入国管理局に同行した。違反審査官は､前回の仮放免の条件が出国準備なので、今回は､帰国の明確な意思表示がなければ仮放免は認められないと回答した。そこで裁決取消の申し立てを準備中であること､再審情願をこの日に提出したことを告げ、仮放免の更新を求めたが、航空券の購入がなければできないと拒絶された。仕方なく８月19日の航空券を母子２人分購入することになった。丸一日の交渉の末、ようやく８月19日までの仮放免が認められ、収容の危機は去った。
そして８月19日が到来。入国管理局は基本的に仮放免の更新を認めないとの方針で臨んでいた。だが午前10時からの話し合いでは、入国管理局は意外にも、再審情願が行われていること、訴訟の申し立て中であることを理由に、新たに仮放免を認めるという回答をしてきた。８月19日までの仮放免の更新は認めないが、一旦収容したこととして、再度仮放免申請を行えばこれを認めるという。収容を想定し身元保証人を同行していなかったため､田中弁護士が急遽身元保証人となり仮放免を申請、認められた。立ち会った違反審査官によると、こうした理由での仮放免はこれまでも数例、認められているとのこと。しかし、APFSのケースの中で何度か訴訟準備・訴訟中を理由に仮放免申請をしたことがあるが、入国管理局は帰国準備という文言を入れないと仮放免は認められないとしてきた。
今回､訴訟申し立て中であること､再審情願を行っていることを理由として、しかも帰国準備という文言を入れないにもかかわらず仮放免が認められたことは、きわめて異例といえる。今後､在特が認められなかった人たちが、公然と国を相手として裁判を起こすことを理由に仮放免を求める道が開かれたものといえる。あとは法務大臣の裁決取り消し訴訟に全力をあげるのみである。

The Excuses Your Bosses Make-Reaching
a Settlement Work Accidents (Part 1)

In our last Newsletter we gave a summary of what bosses often
insist on during our consultations with them. This time, as part of our series,
we want to explain about how solutions are reached and what subjects and problems
arise so that APFS members have a good understanding. We will start with work
accidents.
We also explained in the last issue but company bosses often give us a hard
time. First, the important basics to know are: whether you are a foreigner or
an overstay resident, you can receive work accident insurance(Rosai Hoken),
if you don't have the money to retroactively pay for the insurance, then you
can meet with the Director of Labor Standards for a consultation. If the accident
was a result of your mistake, if it was not intentional, you can get (covered
by) insurance. If the boss says "you don't need insurance for such a small
injury," just remember that the decision is for a doctor and the Labor
Director to make, NOT your boss. If the boss says "We'll go to a doctor
I know to have the injury looked at," just remember you have the right
to choose your own doctor. If your boss tries to offer a settlement of money
instead of insurance, just remember that, even if they will pay Temporary Disability
Benefits (money for rest days), when there is damage left by the injury, the
pay can become a large amount so it is better to refuse the settlement. Finally,
if the boss says that the application for work accident insurance is the employee's
responsibility, just remember that when the application is given to the Labor
Director the company is automatically investigated, so, instead of having trouble
later, the company should co-operate from the beginning and consult with the
employee AND the Labor Director. When we talk with your bosses on the phone
we always explain the above.
When the boss still won't cooperate with us, then we go directly to the company
with the employee, explain the above points again and give the boss the insurance
application forms. Usually, the boss then gives us necessary papers and cooperates.
However, sometimes even after we go to the company, the boss still just gets
angry and won't work nicely with us. The boss tries to escape by saying no one
is responsible or giving evasive excuses. At those times we get the necessary
papers from a doctor and add a paper saying that the company refuses to make
a statement and give all these to the Labor Director.
In the above cases, where the injury is visible such as a cut finger or a broken
bone, we just need to show that the injury took place at work. So, even if the
boss 100% refused to give evidence papers for labor injury insurance, in the
end, the insurance is granted and the employee is covered(However, the decision
regarding wages takes more time).
Next time, we will discuss problems that may arise after reciving labor insurance
for hard labor involving back("koshi") injuries.
前回、労働相談において社長がどのような主張をするのかについて具体的にまとめました。
今回からは、シリーズで、ではどのように解決していくのか、できればそこに生じる様々な問題や課題、そして会員の方にぜひ知っておいてほしいことも付け加えていきたいと思います。今回は労災の場合です。
前回も書いたように、社長はごちゃごちゃと言ってきますが、まず次のように噛んで含めるように（ここが大事）説明します。外国人であっても、オーバーステーであっても適用されること、遡って労災保険に加入する金がないなら労働基準監督署に相談すること。ミスで負傷した場合も、わざとでない限り労災として認められること。たいしたケガじゃない、いちいち労災にするな、と言ってくる場合は、医師や労働基準監督署が判断することであって、社長が決めることではないこと。「俺の知り合いの病院で診てもらってからにしろ」と言ってくる場合には本人が自由に病院を選ぶ権利があること。示談を持ち出してくる場合には、休業補償はともかく､障害が残ったときに、障害補償は高額で裁判沙汰になって、結局会社が損をすること（示談は基本的に拒否します）。などをごていねいに説得をします。最後に､「労災保険は本人申請なので、別に社長が協力をしなくとも、その旨の理由書をつけて、直接労働基準監督署に申請しますので、その際は労働基準監督署から会社に調べが来ますから。いずれにしろ労働基準監督署にばれるのだから、後で問題が起きるより、ちゃんと手続きを取った方がよいと思いますが」と付け加え、労災保険の請求書類を送るから社労士や労働基準監督署とよく相談をし
て協力してください、と言って電話をおきます。
また電話では埒があかないと判断した時は、相談者とともに会社に出向き、同じようなことを再度話し労災保険の書類を渡してきます。大半の場合、これで会社から事業主証明を記した書類が返送されてきます（途中何度か､探りの電話を入れて催促はしますが）。
しかし､スムーズに行かない場合も多々あります。社長が怒鳴り散らして取り付く島もない場合、責任者不在とかで逃げを打ってくる場合､同じような理由をつけてノラリクラリとかわそうとしてくる場合です。そのときは、病院に事情を説明して証明をしてもらい、事業主が証明を拒否した旨の理由書を添付し、労働基準監督署に労災申請をします。
さて、以上述べてきたことは指を切断したり足の骨を折ってしまったと言った目に見えるケガの場合で、さすがに社長も仕事中にケガをしたこと自体は認めざるを得ない場合です。よって、ほぼ１００パーセント、事業主が労災保険の請求書に証明を拒否した場合でも、最終的に申請は認められ労災保険は給付されます。（支給決定までに時間はかかりますが）
次回は、重労働による腰痛等の場合､労災適用後に生じる様々な問題（実はこちらの方が大変）、そして労災の相談員（会員の皆さんがなる可能性もあります）が、ぜひ知っておいてもらいたいことを書く予定です。
We're Back From The Bus Tour!
This year's Annual APFS Bus Tour was held on September 14th and 15th. This
time we went to Mt. Fuji and the area surrounding Lake Kawaguchi. There were
43 rowdy Bangladeshi, Filipino, Nepali, and Japanese participants.
We left early in the morning at 8, and, sure enough, everyone was wearing a
sleepy face. However, in the afternoon everyone one ate the Birani (fried rice)
that the staff had made the night before and fully enjoyed the bus ride singing
songs and talking excitedly.
The course for the trip began with a tour of Sasaichi Sake Factory. People who
were able to drink alcohol taste-tested sake and wine and got into a good mood.
Afterwards, we got into the bus again and headed to Oshinohakkai, a pure Japanese
lake-setting, where we all took pictures with the beautiful scenery as background.
We next went to Asama Jinja, but were short of time so we ran through the tour
and headed to our main destination, Mt. Fuji. Even though it was the middle
of September, the area at the fifth post on Mt. Fuji (there are ten posts dividing
the upward climb to the peak) was hit with extremely cold winds. Everyone took
pictures as they (Buru Buru) shivered. It was too bad that the weather was not
better.
Dinner was an outdoor barbeque. During it, Green-san, our beloved volunteer
who took care of the office, made an announcement that he was returning to Bangladesh
soon. As Green-san spoke, everyone, including Representative Yoshinari and Staff
Member Tsugawa, began yelling out "Thank you Green-san, Arigato."
We really do believe that this trip was memorable for Green-san as well.
The second day, after we circled Lake Shoji and the Shosenkyo caves, we had
Houtou, the delicious Udon Yamanashi is famous for, and went picking grapes.
The children especially had a good time with this.
On the ride back to Tokyo, we played Bingo in the bus and, since the prizes
were so extra special, both people who had "bingo" and those who didn't
were yelling out and having a good time.
We arrived in the evening back at Sambum Hall and everybody was grinning with
satisfaction. As we went our separate ways, we spoke of how fun it was and where
we should go next year.
We would like to thank the office chief Hassan and all our staff for working
so hard. We are looking forward very much to next year as well.
APFS、毎年恒例のバスツアーが今年は９月14日、15日の両日に行なわれました。
今年の行き先は、富士山、河口湖周辺。バングラデシュ、フィリピン、ネパール、そして日本人の総勢43名が大騒ぎで参加しました。
出発の時間が朝８時と早く、みな最初は眠そうな顔でしたが、前日から泊り込みでスタッフが作ってくれたビラニをバス内で食べるお昼頃には、みんなカラオケを歌ったり熱心に話し込んだり、すっかり旅を満喫していました。
コースは、まず笹一酒造という蔵元で日本酒作りを見学。お酒がOKの人は、日本酒やワインを試飲してご機嫌になっていた様子。
その後は再びバスに乗り、忍野八海の純日本的な風景をバックに全員で記念撮影。次いで、浅間神社まで行きましたが、時間がなくて駆け足で見学し、本ツアーのメイン、富士山五合目を目指しました。９月中旬とはいえ、五合目までは寒風が吹いており、みな、ぶるぶると振るえながら記念撮影におさまった様子です。あいにく天気に恵まれなかったのが少し残念でした。
初日の夕食は野外バーベキュー。このバーべキューの途中、これまでボランティアとして事務所に常駐していたバングラデシュのグリーンさんが間もなく帰国するとの少し悲しい発表がありました。参加者全員から「これまでありがとう、グリーンさん！」という声が飛び交いました。グリーンさんにとってもこのツアーはかけがえのない記憶になったことでしょう。
２日目は、精進湖や昇仙峡を見学の後、山梨名物のほうとうに舌づつみをうち、ブドウ狩りを楽しみました。これには子どもたちも大喜びでした。
帰りの車中では、ビンゴゲームが開催されました。賞品がかなり豪華だったこともあり、当たった人も当たらなかった人も嬌声をあげて、大騒ぎとなっていました。バスは夕刻、無事に産文ホールに到着。みな満足した顔つきで「楽しかったね」「来年はどこがいいかなあ」などと話しながら解散していきました。
ハッサン事務局長をはじめスタッフのみなさん、本当にお疲れさまでした。来年もよろしくお願いします。（山口）

●Let's Make The 15th Anniversary Of APFS A Success!!
Since APFS made its first cries On December 20th 1987, 15 years have passed.
In 1987, the Japanese economy was still on the up and up and "newcomers"
were making their way to Japan in great numbers.
At the time, APFS was started with only 20 Bangladeshi youth, but now has over
2000 members. We have also expanded our activities to cover many fields such
as daily consultations, amnesty visas for overstay residents, and forums to
discuss living together in a multi-cultural community.
This year, we are thinking of holding a variety of events for our anniversary.
We plan to show a video to celebrate our 15 years and have materials to show
our history, along with other different events. In order for everything to go
well, we need everybody's power and help. Please give us your support and cooperation.
●On Green-san's Return to Bangladesh
Our much beloved Green-san has made it safely back to Bangladesh. He was known
for working so incredibly hard in the APFS office and carrying a truly peaceful
atmosphere with him. He helped countless people who came to the office for consultations
and other matters. Our fondness for him was heard in our constant calls for
"Green-chan." His slightly serious personality was tempered with sweetness.
Soon after the Bus Tour, his last activity, Green-san took a plane home on the
21st. THANK YOU FOR EVERYTHING, GREEN-CHAN!!!!
At this time, Miah has become staff to help with work in the office. Let's
give him all our support as we work together into the future!!!

●APFS設立１５周年事業を成功させよう
１９８７年１２月２０日に、APFSが板橋の地で産声を上げてから今年でちょうど１５年を迎えます。１９８７年と言えば、日本経済は高度成長の只中にあり、ニューカマーの人々が大挙して日本を訪れていた時期にあたります。
わずか２０人のバングラデシュの青年たちとたちあげられたAPFSは、今では２０００名を超える会員を擁し、日常的な相談活動、非正規滞在外国人の正規化を求める活動、多文化社会における共生を考える諸活動など様々な領域で活躍をしています。
今年､設立１５周年を迎えるにあたってAPFSではいろいろな事業を考えています。１５周年記念ビデオの製作、１５年史の作成、その他にも各種イベントを予定しています。これらのイベントには皆様のお力添えが必要です。ぜひご支援、ご協力をお願いします。
●グリーンさん帰国に寄せて
皆さんもご存知のグリーンさんがこの度帰国しました。年月からＡＰＦＳ事務所の常駐スタッフとしてがんばってきたグリーンさん。彼の周りはいつも和やかな雰囲気でした。相談や事務所に来た際に彼にお世話になった方も多い事でしょう。スタッフの皆から「グリーンちゃん！」と呼ばれ親しまれていた彼。寡黙でしたが本当にまじめでした。グリーンさんはバスツアーを最後に、21日発の便でバングラデシュに帰りました。グリーンちゃん、ほんとうにありがとう！ なお、現事務所ではMiahさんが常勤スタッフとなります。彼を盛り立ててこれからもやって行きましょう！
11月３日（日）、板橋都税事務所前にて、今年もアジアフェアが開催されました。このイベントは地域の外国籍住民との共生をめざして始まったもので、今回で早くも第9回目を数えます。最初は屋外の開催でしたが、現在では屋外へ飛び出し、地域の人々どおし交流を深めるのに一役かってきました。
フェアでは、数カ国の国ぐにの料理や民芸品などが並び、ステージでも民族衣装のファッションショーやビルマの踊り、バングラデシュ、アフリカのバンドのコンサートなどが行なわれ、好評を博しました。
また、今年は来場者に抽選で遊座大山商店街で使用できる商品券をプレゼントするという初の試みがあり、当選者が発表されるたびに、開場では歓声があがりました。
スタッフとして携われた方々、お疲れさまでした。また、遊座大山商店街振興会による後援、ビルマ女性同盟による協力、板橋区文化・国際交流財団による助成により催されました。どうもありがとうございました。
